We were recently asked, “If I just moved to Delaware, will I have to get a new Will drawn up?” Looking into this a bit further, according to the Frequently Asked Questions (FAQs) on New Castle County’s website,  a valid will from another state is also valid in Delaware if it complies with Delaware law or complies with the law in the state where it was executed, or it complies with the law, where, at the time of death, the maker is a legal resident or a national (foreign citizen).

I also checked with Kevin Baird of Baird Mandalas Brockstedt, the attorney that we used to do our wills recently, and here is what Kevin said – “Unless they want to make other changes there is no need to. Wills from other states are valid in Delaware.”
