Allow public to have say on Truitt Homestead

As an attorney, I have represented builders and developers in hundreds of real estate projects for over 45 years. At one time, I also advised a board that dealt with special exceptions. I have argued before the court and before various administrative boards, and am quite familiar with the responsibilities of a judicial body and a quasi-judicial body.

Because of that background, I am quite concerned that the timing of an application for a special exception filed by the Truitts to build and operate an assisted living facility on the Truitt Homestead located on Shuttle Drive across from the DelDOT parking facility may result in an unjust decision by the board of adjustment.

It is this board's responsibility to determine what is in the best interest of the public and the neighbors who are affected by the intended use. Unfortunately, this application was filed just before Christmas, when most folks were out shopping and hardly focused on a land-use application. Now the board is standing on ceremony by refusing to allow the community to submit information, when they have the absolute power to allow it if they so choose. Standing on technicalities, when it defeats and harms the public is a glaring example of unfairness and irresponsibility.

The issue of traffic impact has yet to be thoroughly examined by either Sussex County or DelDOT according to information I have received. Other issues like lack of sewer accommodation for the facility and the use of emergency medical help (including medi-vac) have not been resolved.

Allow the public to have its say.
