Hanewinckel lawsuit continues in Dewey
The day before a Nov. 23 deadline, former Dewey Beach Commissioner Rich Hanewinckel was given an extension on amending and resubmitting a lawsuit filed against Town Manager Marc Appelbaum and former Mayor Diane Hanson.

Hanewinckel filed the lawsuit in September 2015, arguing Appelbaum used the authority of his office to disrupt Hanewinckel's rental business and that Appelbaum arbitrarily enforced town zoning laws against Hanewinckel. The suit also accused Hanson, who is still a commissioner, of conspiring with Appelbaum to obstruct Hanewinckel's businesses. He was looking for $38,000 in lost income, plus the cost of legal fees.

A full year later, Sept. 29, U.S. District Court Judge Leonard P. Stark ruled Hanewinckel's lawsuit failed to state a claim and dismissed it, but left amending the suit open as an option. Hanewinckel has been given until Friday, Dec. 9, to submit his amended complaint.

This has been a year-and-a-half-long process to clean up the streets of Dewey.
