Rezoning hearing for Overbrook Town Center postponed

The anticipated Sussex County Council rehearing of the TD Rehoboth LLC rezoning application has been delayed because of a mistake made in legal advertising for the Tuesday, Feb. 27 public hearing. The hearing will have to be readvertised and placed on a future council agenda.
The developer has filed an application to rezone the 114-acre parcel near the intersection of Route 1 and Cave Neck Road north of Lewes from AR-1, agricultural-residential, to CR-1, commercial-residential, to pave the way for the 850,000-square-foot Overbrook Town Center shopping complex.
The location of the parcel was listed incorrectly as Lewes and Rehoboth Hundred and not Broadkill Hundred where the parcel is located.
Council voted 4-1 on April 12, 2016, to deny the rezoning. The developers filed suit June 8, 2016, in Chancery Court against council, stating three council members who voted against the application made statements not supported by the public record.
Following briefings and oral arguments, the court granted the plaintiff's motion and ordered a new public hearing.
What is a hundred?
A hundred is an unincorporated subdivision of areas in Delaware equivalent to townships in other states. Hundreds – unique to Delaware – date back to colonial times when Delaware was a holding of Great Britain. There are 13 hundreds in Sussex County – the Lewes and Rehoboth Hundred is the oldest dating back to 1692 followed by Broadkill – named for the river – formed in 1696.
