Legislation providing manufactured homeowners with necessary protections before a lot rent increase could go into effect will be signed into law.
Senate Substitute 1 for Senate Bill 33 requires a land owner to justify any proposed lot increase that is above the 36-month average of the Consumer Price Index for Urban Consumers. The legislation also puts in place certain protections for the tenant in the event they disagree with the community owner’s proposal to raise the lot rent.
The bill contains a dispute resolution provision, allowing the matter to be resolved through mediation. If mediation fails, the bill sets up a process for non-binding arbitration that can be appealed to Superior Court.
For many manufactured housing residents in Delaware, this legislation is long overdue. It is the result of many years of hard work and discussion. It ensures fairness in the process and I believe SS 1 for SB 33 will bring about good results and provide necessary relief for many of our thousands of manufactured homeowners and tenants throughout Delaware.
