Court affirms execution by injection
The U.S. Court of Appeals for the Third Circuit has ruled Delaware's method of execution by lethal injection is constitutional.

Ruling in the class-action case Jackson v. Danberg, the court lifted a statewide stay of executions.

Attorney General Joe "Beau" Biden said the ruling affirms a District Court ruling that Delaware's lethal injection protocol meets constitutional safeguards against cruel and unusual punishment.

"As a result of this ruling, executions in Delaware will move forward, and the Superior Court can now begin to schedule executions as appropriate," Biden said.
