Letter: DMHOA requests support for HB 46

Every Delaware resident who lives in manufactured housing on leased land needs your help.

The Delaware Legislature is working on House Bill 46. This bill provides manufactured home owners who live on leased land access to legal help when they are in a dispute with community owners by creating an Attorney Fund. The legal help will be paid for out of the money homeowners already pay to the Delaware Manufactured Home Relocation Trust Fund each month. 

There is no additional cost to anyone.  These funds will ensure that manufactured home owners on leased land are afforded fair and equal protection under the law. The fund will be administered by the Delaware Department of Justice which will contract with an attorney or agency that will provide legal representation and advocacy on behalf of manufactured home owners.

This is critically important, because many of these homeowners are living on fixed incomes (seniors, disabled and veterans) or people who simply cannot afford legal advice and/or representation that would normally cost thousands of dollars. You can read the entire House Bill 46 here: www.legis.delaware.gov/BillDetail?LegislationId=37121. If you live in manufactured housing on leased land, we respectfully ask for your help and support by doing the following:

• Identify your elected officials at: legis.delaware.gov. On the top right of the page is a brown box labeled “Who is My Legislator.” Type in your address, click on “Find my Legislator.” The names and email addresses of your two elected representatives appear.  Email or call both of your elected officials and tell them: I live in manufactured housing on leased land in your district.  I am a voter. I want you to support and co-sponsor House Bill 46.

My home is the most expensive financial investment I have in this state.  I deserve legal representation when my landowner takes advantage of me by either raising the land rent over the CPI-U or arbitrarily includes their corporate costs. If you choose not to support this bill, I ask you to email or call me with your reasoning so I might fully understand your position.

If you are a Delaware resident and do not live in a manufactured housing community on leased land, we respectfully request your help in order to support your Delaware neighbors who do live in manufactured housing and are dependent upon landowners to be fair.
