Milton adopts ordinance on temporary structures

Use of dumpsters, portable toilets regulated under new measure

Milton Town Council unanimously approved an ordinance that would regulate the placement of temporary structures.

The ordinance establishes regulations for temporary structures for construction equipment, such as PODS or dumpsters, and social events, such as tents and portable toilets. Prior to enacting the ordinance, there were no rules for when such structures could be erected or when they had to be removed.

For construction purposes, which includes demolition, maintenance and repair, applicants must apply for a permit 72 hours before the structure is placed. The structure must be removed after the project is complete. Applicants are limited to a dumpster, one storage unit and one portable toilet.

At their Jan. 7 meeting, council added language for temporary structures needed for moving, which would require the same application process as construction.

The town will also allow temporary structures for private social gatherings and events, and for public festivals or exhibitions. For private events, an application must be filed 72 hours before the structure is installed and it must be removed when the event is over. For public events or festivals, an application must be filed 14 days before the event. Town Solicitor Seth Thompson said the number of temporary structures allowed at events would be at the town manager’s discretion.

Town officials said they created the ordinance in response to temporary structures that were left in place for long periods of time, but officials had no enforcement mechanism in place for removing them.
