Milton man dies after crashing Mercedes into garage

February 6, 2023

A 20-year-old Milton man died following a crash Feb. 4 into an attached garage south of Milton.

The crash happened about 12:30 a.m. when Charles Maxwell was driving a 2003 Mercedes-Benz E-320 southbound on Route 5 north of Diamond Farm Road at a high rate of speed when he failed to negotiate a gradual curve in the road, said Sr. Cpl. Jason Hatchell of the Delaware State Police.

The Mercedes continued moving southeasterly and struck a stop sign at the intersection of Route 5 and Diamond Farm Road before heading into the yard of a home in the 17000 block of Harbeson Road, Hatchell said.

The car then overturned several times before crashing into the attached garage of the home, finally coming to a stop upright but landing on top of a 2019 Toyota 4-Runner parked in the garage, Hatchell said.

Maxwell was properly restrained and transported to an area hospital in critical condition, but police reported Feb. 6 that he died Feb. 4 at the hospital.

Harbeson Road was closed for about four hours.

The Delaware State Police Troop 7 Collision Reconstruction Unit continues to investigate this incident. Troopers ask anyone who witnessed this collision to contact Cpl./1 J. Smith at 302-703-3267. Information may also be provided by sending a private Facebook message to the Delaware State Police or calling Delaware Crime Stoppers at 1-800-847-3333.
