Overbrook site housing project on Sussex P&Z agenda

Subdivision is first of two planned for former shopping center parcel

The first phase of a housing project east of Route 1 near the Cave Neck Road intersection will be subject of a Sussex County Planning and Zoning Commission public hearing at 6 p.m., Thursday, Aug. 9.

Overbrook Real Estate Partners LLC of Brookfield, Ohio, has filed an application for Overbrook Meadows, a 135-single-family-lot subdivision on 64 acres of agricultural-residential, AR-1, land, part of a 114-acre parcel north of Lewes first proposed for Overbrook Town Center, a 850,000-square-foot shopping center.

The owner of the parcel is Overbrook Acres LLC of Hanover, Va.

Because the application is for a subdivision, it will be heard only by the planning and zoning commission and not by county council.

The commercial rezoning for the project was rejected twice by Sussex County Council.

During the Delaware Office of Planning Coordination Preliminary Land Use Service review process, state transportation officials have required the developer to construct a grade-separated, overpass at Cave Neck Road for access to the parcel. In comments back to state officials, the developer noted construction of the overpass could begin in fall 2019 with funding yet to be determined.

The developer has also proposed a right-out-only exit near the northern edge of the property line.

Hearings take place in the county administration building, 2 The Circle, Georgetown.

The developer has plans to file an application for Overbrook Meadows West at a future date for an additional 105 single-family lots on the remaining 50 acres of the parcel, bringing the total number of lots to 240.

Application has a long history

The application has a long history. Council voted 4-1 April 12, 2016, to deny a rezoning request filed by the developer, from AR-1 to CR-1, commercial residential, for the parcel of farmland.

The planning and zoning commission recommended approval of the application.

The developers filed suit June 8, 2016, in Chancery Court against council, stating three council members who voted against the application made statements not supported by the public record.

On Aug. 11, following briefings and oral arguments, the court granted the plaintiff's motion and ordered a new public hearing.

Following the new public hearing, council voted 3-2 to deny the application a second time.

Beebe expansion project on agenda

Also on planning and zoning commission's agenda is an application filed by Beebe Medical Center Inc. to rezone a 20-acre parcel at the southeast corner of Route 24 and Warrington Road between Lewes and Rehoboth Beach from AR-1 to I-1, institutional district.

Beebe officials have plans to construct an 88,495-square-foot surgery center and health campus at the site adjacent to its existing Route 24 complex.
