New Auto Insurance Law Gives Delaware Insured More Benefits

Underinsured motorist coverage is voluntary insurance that a Delaware driver can purchase which protects them in the event they are injured and the at-fault driver does not have enough insurance to pay for their injuries, medical bills and lost wages.

The law in Delaware concerning this type of insurance coverage changed.  Under the old law, you could not use your own insurance (that you pay premiums for) if your policy and the at-fault driver's policy had identical limits, or if the at-fault driver's limits were higher than yours.  Simply, whether you could use your own insurance was dependent on the policy limits of the at-fault driver.  The law made no sense. 

Thankfully, the law changed and there is no requirement to compare the policy limits anymore.  So what does this mean for you?  The new law is better and will provide additional insurance coverage.  However, if your auto insurance policy first began before January 3, 2014, you may subjected to the old law.  It would be unfortunate if you or a family member sustained significant injuries from a car accident but still had an old policy.
