Old Orchard on board’s Dec. 10 agenda
At its Monday, Dec. 10 meeting, the Sussex County Board of Adjustment could vote on a special-use exception filed by Old Orchard Ventures LLC for Tranquility at Breakwater, a 75,000-square-foot, three-story assisted-living, skilled-nursing facility home on a 7.5-acre parcel along Old Orchard Road near Lewes. After a Nov. 5 public hearing, the board tabled the application for further review of the record.

The proposed project is part of a plan to develop a 25-acre parcel along the roadway with mixed uses including multifamily housing and offices. The meeting gets underway at 7 p.m. in the county administration building, 2 The Circle, Georgetown.

Couple gets court-ordered board hearing
The Sussex County Board of Adjustment will hear an application at its Monday, Dec. 10 meeting filed by Jason and Stacy Harshbarger for a special-use exception to move a modular, stick-built dwelling into a nonconforming mobile home park at 32 South Shore Drive along Indian River Inlet near Bethany Beach.

On Sept. 18, 2017, the board rejected an appeal made by the couple of a planning and zoning director’s decision to not allow a hearing. Janelle Cornwell told the board county code is specific that only one modular or stick-built home is permitted for the manager in a manufactured home park.
Jason Harshbarger argued that a precedent had been set with prior approvals of other housing types than manufactured homes in the park, which predates county zoning. The couple had purchased a $350,000 modular home.

The couple then filed an appeal with Sussex County Superior Court. On Aug. 29, Judge E. Scott Bradley ruled the board erred in its decision and the couple should be able to file a special-use exception application. The meeting gets underway at 7 p.m. in the county administration building, 2 The Circle, Georgetown.
