Rehoboth Beach man charged with shooting, assault

A Rehoboth Beach man faces gun and assault charges after an argument with another man July 4 in the parking lot of the Rehoboth Beach YMCA.

Police were called at 12:05 a.m. to 20080 Church St. after 40-year-old Allan Simms punched another man, 40, said Sr. Cpl. Leonard DeMalto of the Delaware State Police.

After the fight, DeMalto said, Simms returned with a firearm and fired one round at the man, but missed.

Simms fled from the area in a dark blue Dodge Caliber, which was located unoccupied in nearby Burton Village. While searching the car, DeMalto said, police found a Smith & Wesson long rifle, and computer checks of Simms revealed that he is a convicted felon prohibited from possessing a firearm.

No other subjects were injured in the incident, and the male victim did not require emergency medical attention.

Simms turned himself in to Troop 7, where he was charged with felony possession of a firearm during the commission of a felony, felony possession of a firearm by a person prohibited, felony first-degree reckless endangering and third-degree assault.

Simms was arraigned at Justice of the Peace Court 3 and committed to Sussex Correctional Institution in default of $66,000 cash bond.
