Paving contractor files application to move business

New location would be on 40-acre parcel along Route 9

The owner of a Rehoboth Beach paving and construction business is looking to move his business to a larger parcel, but the move requires a conditional-use approval approved by Sussex County officials.

Peninsula Paving owner Fletcher Kenton and his attorney Blake Carey presented their case to the planning and zoning commission during a Jan. 10 public hearing.

Yellow Metal LLC has filed a conditional use for a paving/construction business with an office and equipment storage on a 40-acre parcel off Route 9 at 20288 Broadogs Place near Georgetown. The property is currently owned by Dawn Thompson, a former Punkin Chunkin world champion.

Carey said the company employs 15 to 20 people depending on the season. He said workers would come to the site and leave in company vehicles to go to job sites. Two existing pole buildings – 2,400 square feet and 3,200 square feet – on the site would be used; no new buildings are proposed.

Carey said the site is isolated and woods block the view of the property from Route 9.

Kenton said the parcel would provide space for growth, which the company does not have at its current Old Landing Road location. The applicant asked to have the use of the property listed as construction services.

Commission President Bob Wheatley said the term construction services was broad. “I suggest you be more specific in the activities taking place there,” he said.

Kenton said the only work that would take place on the site would be milling of leftover asphalt from the day's work.

Assistant county attorney Vince Robertson said milling and potential stock piling of material was a concern. The commission agreed and worked out possible conditions with the applicant to allow milling to occur from 3 to 6 p.m. and storage of no more than 50 tons of material on site.

Kenton said milling typically occurs near the end of the work day and takes about 20 minutes.

The commission deferred a vote to a future meeting. County council has scheduled a public hearing at 1:30 p.m., Tuesday, Feb. 5, in the county administration building, 2 The Circle, Georgetown.
